Distinction between admission and confession




1. Admission is used in civil and criminal proceedings but confession is used in criminal proceedings.
2. Section 17 to 23 and 31 of evidence Act is about admission and section 24 to 30 of evidence Act and section 164 of the Code of criminal procedure is about confession.
3. Admission can be regarding any fact, relevant fact or fact in issue. But confession must be admission of guilt for which he is alleged.
4. Any person can make admission but only accused can make confession.
5. Confession may be conclusive proof but admission is not the conclusive proof.
6. Confession goes against accused but admission may be goes on behalf of the person making it.
7. Admission has defined in the Act but confession has not defined in the Act.
8. All confessions are admission but all admissions are not confession.
