She/he
must have title to the property or authority to transfer it, if it is not his
own.
Competency
to transfer depends upon the competency to contract.
Section
11 of Contract Act deals with the competency to contract.
- Every person is competent to contract
- Who is of the age of majority
- Who is of sound mind
- Who is not disqualified from contracting by any law to which he is subject.

Under section 3 of Majority Act, 1875,
person attains majority at the age of 18 years.
