Definition: Section 32(1) of the evidence Act is about dying
declaration.
A dying declaration is a
statement by a dying person as to the cause of his death, or as to any of the
circumstances of the transaction which resulted in his death. The statement of
dying person can be oral or written.
Features of Dying declaration:
1. The person making
statement must be death.
2. The statement must be
related to his cause of death.
3. The cause of his death must
be in question.
4. A person makes dying
declaration in the sense of impending death.
